Longmont City Council gives initial approval to RV street parking ban - Longmont Times-Call

Longmont City Council members on Tuesday voted 4-3 to give initial approval to an ordinance that would generally prohibit recreational vehicles, camper coaches, camper trailers and motor homes from parking on city streets, in alleys, on trailheads and in other public rights of way or on publicly owned parking lots.

That vote followed a debate over the impacts of the measure — debates expected to resume when the ordinance is up for a public hearing and a final council vote on Nov. 10.

The measure, which in its current form would take effect Jan.. 1, would eliminate a provision in Longmont’s current city code that now allows so-called “sleeper vehicles” to be parked on streets, as long as those vehicles are moved at least 600 feet every 48 hours.

Councilwoman Polly Christensen objected to a number of provisions and part of the language in the proposed ordinance, including the use of the term “sleeper.”

“It’s an erroneous term and confuses things,” said Christensen, who argued that the measure should focus on trying to resolve the problem of people residing in, and sleeping in, and living in vehicles.

She said the ordinance should cover “any vehicle converted to sleep in.”

Councilwoman Joan Peck asked whether the ordinance would apply to any vehicle, including cars, parked for more than 48 hours on the street in front of a home, without being moved.

Assistant City Attorney Tim Hole said that’s already in the current code.

But Peck suggested that that discriminates against residents of some parts of Longmont who don’t have off-the-street garages and must park their vehicles on the streets in front of their homes.

If such vehicle owners are away from home for a week or two but leave those vehicles behind, the city code subjects them to being ticketed and towed, Peck said.

Christensen said she thought Council should hold off on further consideration of the RV street parking ban until city staff can resume looking for possible sites for RV owners to temporarily park their vehicles.

Voting for initial approval of the ordinance Tuesday night were Mayor Brian Bagley and Council members Tim Waters, Aren Rodriguez, Susie Hidalgo-Fahring. Voting against it were Council members Christensen, Peck and Marcia Martin.

Tuesday night’s Council consideration did not include a formal public hearing on the proposed parking prohibitions. Council members did hear objections to the measure from several people who called in during a public-invited-to-be-heard opportunity.

Stanley Tolle, who lives in an RV, charged that passage of the ordinance would violate Colorado open meetings laws because Council discussions of the measure have been made during virtual meetings at which Council and staff members participated remotely, rather than giving the general public an opportunity to be present in the same room and talk in person to Council members.

Tolle complained that the city hasn’t made an effort to involve RV and camper occupants in its meetings and that participating remotely isn’t possible for many of those occupants.

Another woman, who also said she lives in an RV, said she’s been “playing by the rules” and moving her vehicle as frequently and as far as the current city code requires. People like her should be grandfathered in to any ordinance prohibiting such parking and allowed to continue to follow the previous policy, she said.
