Ware orders Main Street building torn down; owner plans legal action - MassLive.com

WARE — In two unanimous votes last week, the Board of Selectmen deemed 112-114 Main St. a dangerous building and ordered the owner to demolish it by Oct. 1.

The building was condemned nine years ago when a portion of the roof collapsed.

Daniel Barenboym, one of two owners of the building, objected to the order and said he plans to consult with his attorney and fight the town.

“It seems like you guys are going to do nothing but put roadblocks in front of us,” Barenboym told the board. “I need to determine what am I going to do with this building.”

“On your determination, I’m going to have to speak to the lawyers ... and have to go the lawyer way,” he said.

Should the owner opt not to demolish the building, the board said the town would have it demolished on its own.

That would require an appropriation of money. Subsequent to the July 21 meeting, the board scheduled a special Town Meeting for Aug. 17. Town Manager Stuart Beckley said the cost of demolition has not yet been determined.

Town officials say there is danger the building could collapse and fall into the street, potentially injuring or killing people. An engineering report for the town said the building is unsafe.

The structure was condemned shortly after a portion of the roof caved in Feb. 9, 2011, likely due to the weight of several feet of snow and ice accumulation that winter. Businesses that had been renting office space at the time were given two hours to clear out.

Nothing has been done to repair the roof, though 112-114 Main St. has been bought and sold since it was condemned nearly a decade ago, according to town records.

The owners at the time of the roof collapse were Binh Hue Truong and Hon Hoang. They sold it for $1 in 2013 to 118 Main Street Ware LLC, according to Hampshire County Registry of Deeds. That firm sold the building to ERA Development LLC in 2016 for $8,000. Barenboym is listed as both agent and the manager for the company.

Property records provided by the town of Ware show ERA sold the property for $60,000 in 2019 to 114Main LLC. Barenboym and Vladimir Gressel are listed as managers.

“The building, when we purchased it ... unfortunately, we didn’t realize how badly it was deteriorating,” Barenboym told selectmen on July 7.
