Answer Man: Isn't mask wearing illegal? Does Asheville still have street sweepers? - Citizen Times

Today’s batch of burning questions, my smart-aleck answers and the real deal:

Question: North Carolina General Statute 14-12.8 prohibits the wearing of masks or hoods on public property. Could you check with the District Attorney's office and ask them if they have ever prosecuted anyone under this statute, and whether this would prohibit people from wearing face masks to fight the coronavirus?  

My answer: No, but their daggum addiction to freedom would!

Real answer: The statute mentioned does prohibit masks, hoods and devices worn "for the purpose of concealing identity," Buncombe County District Attorney Todd Williams said.

"Masks worn for other purposes (or for epidemiological purposes) are not prohibited by North Carolina law," Williams said. "I do not recall law enforcement charging a violation of this statute since I became District Attorney."

Williams was first elected in 2014.    

Question: I live in North Asheville in the Lakeshore area, but I’ve noticed this problem in other parts of Asheville as well: Does the city not run street sweepers anymore? Do they do any kind of street clean ups? The streets are often full of trash and litter and other debris, both in the downtown and in the neighborhoods. Has the city just stopped doing street cleanups?

My answer: Remember back in the pre-riot days when dirty streets seemed like the worst of our problems? OK, maybe pandemic deaths did, but still, feeling nostalgic.

Real answer: The city does still have street sweepers, but they're not out as much.

"Because of the COVID-19 event, Asheville Public Works had to redeploy some workers to other divisions, such as to assist Sanitation," city of Asheville spokeswoman Polly McDaniel said. "At this time, we are not running our normal routes for street sweepers but we are responding to calls for service."

McDaniel suggested using the Asheville App online or calling the Stormwater Division at 828-232-4567, or the city's customer service line at 828-251-1122.

"Downtown street sweeping is still operating as normal," McDaniel said via email, well before the protest events that unfolded this week. "Please note that, for normal operations, we only run street sweepers on those streets that have curbing."

The city encourages use off the Asheville App for issues such as litter, potholes, street lights, street sign damage, overgrown lots, abandoned vehicles, zoning violations and other similar issues, McDaniel said.
